Section 01

Cancellation Policy

(1) You may cancel your membership and receive a full refund within three business days of signing this contract by providing a written notice to Elk Fitness and returning the access card. If the access card is not returned, Elk Fitness will deduct the cost of the card from the refund.

(2) If you wish to cancel your membership before the end of the agreed term, you may do so by providing a 30-day written notice. An early cancellation fee of $200 will apply.

(3) If you die or become totally and permanently disabled, you or your estate may cancel this contract by providing a written request and certifiable proof of disability or death. For permanent disability, your doctor must provide certification and state that you are unable to use Elk Fitness; no cancellation fee will be charged.

(4) The Club retains the right to cancel or suspend the membership of any person for any reason. If such cancellation or suspension is made due to a violation of gym policies, violation of contract terms, or damage by you or your guests, you remain responsible for the financial obligations of this contract as well as a $200 cancellation fee. Where the facility or its contents are damaged, you are also responsible for the repair or replacement.

(5) If the gym goes out of business or moves more than 7 kilometres from its present location, you may cancel by written notice and will receive a pro-rata refund of any prepayments.

Any payments due prior to cancellation taking effect will still be due and payable. Your account must be current before any cancellation will take effect.

Section 02

Designated Billing & Auto-Renewal

Provided that the Member is not in default of this agreement, the membership will automatically renew at the rate disclosed at signup. Renewal terms may be cancelled at any time with 30-day written notice. Elk Fitness may increase recurring renewal dues without notice during any renewal period, not to exceed $10 per payment.

Elk Fitness reserves the right to change the Designated Billing Company at its discretion. If such a change is made, the full terms and conditions of this agreement continue to apply, and you authorize the new billing company to continue drafting your account.

Section 03

Default, Late Payments & Sales Tax

Should you default on any payment obligation, Elk Fitness may declare the entire remaining balance due and payable. You agree to pay (pre-judgment and post-judgment) interest at 12% per year and all collection costs, including collection-agency fees, court costs, arbitration costs, and lawyer fees on a solicitor-and-client (full indemnity) scale. A default occurs when any payment is more than 15 days late.

A service fee will be charged for any cheque, draft, credit card, or order returned for insufficient funds or any other reason. Past-due recurring payments will incur a late fee. Elk Fitness reserves the right to charge any payment method on file for amounts owed, including late fees and service fees, subject to applicable Provincial and Federal law.

Recurring dues are based on current sales-tax rates. If those rates increase during your membership, Elk Fitness may increase the recurring dues by the amount of the increase. Pre-authorized debit amounts will be adjusted accordingly.

Section 04

Freeze & Facility Maintenance

If you have a term membership (e.g. 12-month), you may freeze your membership for a medical reason in 30-day blocks. We may ask for documentation. Freezing does not stop your payments — you remain liable for the original payment schedule. Once you resume any usage of the gym, the freeze terminates. Time frozen is credited to the end of your membership's original term.

Military: if you are deployed or assigned to active duty during the term, the gym will allow you to freeze your membership for the absence on written request with proof of deployment.

A $20.00/month freeze fee applies. The gym may be temporarily closed for periods of up to 2 weeks per year for maintenance.

Section 05

Member Obligations & Club Rules

Member agrees to abide by all gym policies, follow staff direction on safety and security, and treat staff and other members with courtesy. Member agrees to pay recurring dues on time, to notify the gym promptly when banking or card information changes, and to pay declined-payment, late, and collection fees that arise.

Member must present a membership card on entry and may be denied access without it. Member agrees not to engage in commercial or business activity inside the facility, including acting as a trainer for other members or guests; doing so may result in immediate cancellation and the contract balance becoming due in full.

Flip-flops and bare feet are not allowed. Bring clean indoor shoes for the gym. Re-rack weights, wipe equipment after use, and use the safety features of all equipment. Horseplay, vulgar language, equipment abuse, or working out while intoxicated will not be tolerated and may result in suspension or cancellation.

Cell-phone use is not permitted in the cardio area. Photography and videography are not allowed anywhere in the club. Persons under the age of 18 are not permitted in the gym.

Failure to use the facility does not release the member from the obligation to make all payments required by this agreement. Elk Fitness retains the right to modify these policies; reasonable rules may be posted at the gym or on the website from time to time, and members are subject to strict compliance.

Section 06

Photo & Media Release

Member understands they may be photographed at the gym. By signing this agreement, Member agrees to allow their photo, video, or film likeness to be used for any legitimate purpose by Elk Fitness and its respective producers, sponsors, organizers, and assigns, in their sole discretion.

Member acknowledges that by signing, they give up all claims of ownership, income, editorial control, and use of such media, and assigns all copyright ownership to Elk Fitness.

Section 07

Safety & Surveillance

This facility is under 24-hour recorded video surveillance, which may be retained by the gym for subsequent review. Member access-card usage is logged.

Member is required to use the safety features of the equipment. If you are unsure how to use a machine, obtain instructions from the staff. This is an UNSUPERVISED FITNESS CENTER outside of staffed hours.

Cell phones are not permitted in the cardio area. Photography and videography are not allowed anywhere in the club. Persons under the age of 18 are not permitted in the gym.

Section 08

Pre-Authorized Debit (PAD) Authorization

I authorize the Designated Billing Company selected by the gym to draw items (cheques, electronic fund transfers, charge card) for the purpose of paying membership dues, including any late fees, service fees, and other purchases on the account I provide.

I am entitled to notice at least 10 days before each payment of when it will be made and how much it will be. By executing this preauthorization I instead choose to receive notice only when the payment differs by more than $50.00 from the most recent payment. I also waive the 10-calendar-day pre-notification requirement for changes to the PAD due to changes in the applicable tax rate, top-ups, or other adjustments.

The privilege of making payments under this arrangement may be revoked by the Company if any item is not paid upon presentation. If this preauthorization is revoked for any reason, this does not release me from my Payment Schedule obligation.

A service fee will be assessed and drafted for any cheque, draft, credit card, or order returned for insufficient funds or any other reason. A late fee will be assessed and drafted should any recurring payment become past due.

Elk Fitness and/or its agents may store the account or card information I provide for the purpose of processing all dues, fees, taxes, purchases, and incidental charges that are or will become due, including all items on the Payment Schedule and any subsequent agreements between me and Elk Fitness.

Section 09

Assumption of Risk & Release of Liability

I understand that the risk of injury from gym activities and from using gym equipment is significant, including the potential for permanent paralysis and death. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown. I acknowledge that this is an UNSUPERVISED FITNESS CENTER outside of staffed hours.

I release Elk Fitness, its owners, employees, contractors, and affiliates from any and all liability arising out of my use of any equipment, products, machines, or facilities of the gym, or any indoor or outdoor exercise program offered at or by the gym, or any incident that occurs while using such facilities, or otherwise related to my membership.

This release is intended to be as broad and inclusive as permitted by applicable law. If a portion is held invalid, the balance shall remain in full force and effect. This release applies to my heirs, assigns, personal representatives, and any other next of kin. Elk Fitness is relying on this release in agreeing to enter into this agreement.

I HAVE READ THE RELEASE OF LIABILITY AND ASSUMPTION OF RISK, FULLY UNDERSTAND ITS TERMS, AND ACKNOWLEDGE THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

These policies form part of the Elk Fitness Membership Agreement. By signing the agreement during signup, you confirm you have read, understood, and agreed to each section.
